1. Acceptance of Terms

Welcome to Plush Art 3D. These Terms of Use ("Terms") constitute a legally binding agreement between you ("User" or "you") and Gamiable regarding your access to and use of the Plush Art 3D mobile application, services, and associated web viewers located at plush.gamiable.com (collectively, the "Service").

BY DOWNLOADING, INSTALLING, ACCESSING, OR USING THE SERVICE, YOU AGREE TO BE BOUND BY THESE TERMS. IF YOU DO NOT AGREE, DO NOT USE THE SERVICE.

2. Age Eligibility & Account Registration

  1. Age Requirements: The Service is suitable for users of all ages, subject to feature limitations based on age. If you are under the age of digital consent in your country (e.g., under 13 in the United States, under 16 in parts of the European Union), you must have permission from your parent or legal guardian to use the Service.
  2. Age Verification: You agree to provide accurate, truthful birth date information during the neutral age screening. Falsifying age information to bypass safety restrictions is a violation of these Terms.
  3. Account Creation: Certain features (such as publishing plushies, liking, or commenting) require signing in via an authorized third-party authentication service (Facebook Login, Google Play Games Services, or Apple Game Center). You are responsible for maintaining the security of your third-party account credentials.

3. User-Generated Content (UGC) Policy

Plush Art 3D allows users to create, assemble, color, and publish 3D plushie models, titles, tags, and comments ("User-Generated Content" or "UGC").

4. Safety, Moderation, & Reporting Mechanisms

To ensure compliance with Apple App Store Guideline 1.2 and Google Play UGC Policies, we maintain a zero-tolerance policy for abusive or illegal content:

  1. Automated Screening: All public UGC (plushie titles, comments, and rendered thumbnails) undergoes automated AI text and image filtering prior to or upon publication.
  2. In-App Reporting: Any user can flag offensive plushies or comments using the in-app "Report" button (🚩). Reports are routed to our moderation team for review within 24 hours.
  3. User Blocking: Logged-in users can block any content creator. Blocking a user instantly hides all of their published plushies, comments, and profile interactions from your personal view.
  4. Content Removal & Account Suspension: We reserve the right to immediately remove any UGC, restrict account features, or permanently terminate accounts that violate these Terms or platform policies without prior notice.

5. DMCA & Copyright Infringement Policy

Gamiable respects intellectual property rights and complies with the Digital Millennium Copyright Act (DMCA) (17 U.S.C. § 512) and international copyright standards.

A. Notice and Takedown Procedure

If you are a copyright owner or authorized agent and believe that a plushie or content hosted on Plush Art 3D or plush.gamiable.com infringes your copyright, you may submit a written DMCA Notice to our Designated Copyright Agent at copyright@gamiable.com containing:

  1. Identification of the copyrighted work claimed to have been infringed.
  2. Identification of the material claimed to be infringing (including the specific Plushie ID or Web URL: e.g., https://plush.gamiable.com?id=XXXXX).
  3. Your contact information (Name, Address, Phone Number, Email).
  4. A statement that you have a good faith belief that use of the material is not authorized by the copyright owner, its agent, or the law.
  5. A statement, under penalty of perjury, that the information in the notification is accurate and that you are authorized to act on behalf of the copyright owner.
  6. Your physical or electronic signature.

If your content was removed due to a DMCA notice and you believe this was due to mistake or misidentification, you may submit a written Counter-Notification to copyright@gamiable.com containing your contact info, identification of the removed item, a statement under penalty of perjury asserting your right to use the content, and consent to legal jurisdiction.

C. Repeat Infringer Policy

Gamiable will terminate, in appropriate circumstances, the accounts of users determined to be repeat infringers (e.g., accounts receiving three valid DMCA takedown notices within a 12-month period).

  1. "AS IS" Basis: The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied.
  2. Third-Party Content: Gamiable is not responsible for the accuracy, safety, or appropriateness of User-Generated Content published by third-party users.
  3. Limitation of Liability: To the maximum extent permitted by applicable law, Gamiable shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use or inability to use the Service.

8. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles. Any legal suit, action, or proceeding arising out of or related to these Terms or the Service shall be instituted in the competent courts of Hanoi, Vietnam.
